Official Rules

By participating in this promotion you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of Twist On It. These Official Rules prevail in the event of any conflict or inconsistency any other communications, including advertising or promotional materials.

Eligibility:

 

1. The giveaway is open to US residents aged 21 years old or over on the opening date of this promotion, excluding anyone professionally connected to the promotion.

2. Entry to this promotion requires the entrant to have a personal, valid and current Instagram, Facebook and/or email account.

3. Maximum 1 entry per person. Anyone trying to circumvent this rule by using alternative details will be disqualified from this promotion. Bulk entries made from trade, consumer groups or third parties will not be accepted. If any entrant creates numerous Facebook, Instagram or email accounts in order to enter the Promotion more than once, they will be disqualified.

4. The Promoter(s) reserves the right to challenge the eligibility of any entrant selected as winner, in which case prize fulfillment will only be possible once proof of eligibility has been provided.

1. The promotion will run on December 12, 2020 to December 30, 2020 only.

 

How to enter:               

                                 

Three ways to enter:

 

1. Follow @twist_on_it on Instagram and tag at least two people;

2. Like Twist On It Facebook Page and tag at least two people; and/or

3. Online entry at www.twistonit.com and subscribe.

 

Regardless of entry method, you may enter only once.  All entries must be received by 11:59 p.m. MST of the last day of the Giveaway; i.e., December 30, 2020.

 

No purchase necessary to enter or win:

1. To enter the promotion, entrant must: ‘Comment’ on the relevant post as specified by the Promoter(s), ‘Tag’ at least two other Instagram or Facebook accounts and/or subscribe to www.twistonit.com

Prize:

​

1. There will be 1 x prize to be won consisting of 1 x Whiskey Glassware gift box – included: set of 2 Whiskey glasses. Chilling Stones, Tongs, and 2 slate table coasters. No alcohol is included in this prize.

Prize Condition:

​

1. No cash equivalent of prizes is permitted. Prize is not redeemable for cash and non-assignable and non-transferable. If necessary due to the unavailability of the prize, the Promoter(s) reserves the right to substitute similar alternatives of equal or greater value. Winner is responsible for all federal, state, local sales and income taxes.  Any other incidental expenses on prize not specified herein are the sole responsibility of winner.  Entry and acceptance of prize constitute permission to use winner’s name and prize won.  Prize is guaranteed to be awarded.

 

Winner Selection:

 

1. The winner will be selected at random from all eligible entries received.  Random drawing will be conducted on or about December 31, 7:00 a.m. by representative from the Promoter(s) whose decisions are final and binding in all matters relating to this Giveaway.  Winner will be announced January 1, 2021. 

 

Winner Notification:

 

1. The winner will be contacted by a representative from Twist On It via the social media or email account on which the potential prize winner entered within 48 hours of the draw. Each entrant is responsible for monitoring his/her social media and/or email account for prize notification and receipt or other communications related to this giveaway.  In the event the claim for a prize is not received by the Promoter(s) within 72 hours of such notification, or they are deemed not eligible, the Promoter(s) reserves the right to withdraw prize entitlement and award the prize to a reserve selected at the same time as the original. No responsibility can be taken for claims which are lost, delayed, corrupted, damaged, misdirected or incomplete or cannot be delivered for any technical, delivery or other reason.  If a potential winner fails to comply with these official rules, that potential winner will be disqualified.  If entrant is found to be ineligible or declines acceptance of the prize for any reason, an alternate winner will be selected.

Promoter(s) reserves the right to disqualify any entrant acting in violation of the Official Rules or found tampering with the entry process or with the operation of the Giveaway or the website. The Giveaway is governed by the laws of the United States and, by entering, all Winners and entrants hereby submit to the jurisdiction and venue of the federal, state and local courts located in [Denver, CO]. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE RELATED TO PROMOTER(S) OR THE GIVEAWAY OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER(S) RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.

1. If the winner cannot be contacted, or if the selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited then an alternative winner will be selected instead.

2. When entering, you acknowledge that your entry, name and social media details will have been made available to the Promoter(s) for the purposes of administration of the Giveaway and as otherwise permitted in accordance with Twist On It’s Privacy Policy which can be found at www.twistonit.com/privacy-page.

4. The Promotion is in no way Promoted, endorsed or administered by, or associated with Facebook or Instagram. You are providing your information to the Promoter(s), not Facebook or Instagram. The information you provide will only be used for the promotion. By entering the promotion all participants accept that they have no claim against Facebook or Instagram whatsoever.

5. Unless otherwise agreed in writing by the Promoter(s), the prize will only be awarded directly to the winners. The Promoter(s) will not be liable for any cancellations, alterations or modifications to the promotion as detailed above or the prizes for any reason which falls outside its reasonable control.

6. The Promoter(s) assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Promoter(s) is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter(s) on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this draw.

In the event of circumstances outside the reasonable control of the Promoter(s), or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, the Promoter(s) reserves the right to cancel or amend the promotion or these terms and conditions, at any stage.

The Promoter(s) reserves the right in its sole discretion to verify all entries including but not limited to asking for address and identity details (which must be provided within 14 days) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion or disqualify any individual who tampers with the entry process or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.

9. Acceptance of the prize authorizes the Promoter(s) to publish the name of the winners. Where consent is not provided, or where a winner does not wish to accept the prize, an alternative winner will be selected instead.

10. The Promoter(s) shall not be liable for any failure to comply with their obligations where the failure is caused by something outside their reasonable control.

11. The Promoter(s) accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the competition or accepting the prize.

12. The Promoter(s)’s decision is final regarding the choice of winners and to all promotional matters.

13. Entries that do not comply with these Official Rules, or where entrants are found to be abusing the promotion in any way, will result in the disqualification of all relevant entries.

Release of Liability:

By participating, Winner and entrants agree to release, discharge, indemnify and hold harmless Promoter(s) from and against any claims made by the Winner, entrants or any other third parties related in any way to the operation of this Giveaway, as well as any other claims and liability relating to their participation, acceptance and use or misuse of prize.  Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Giveaway or use or redemption of prize.  Promoter is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway or in the announcement of the prize.
